1. User Responsibilities
You are solely responsible for your trading activities on ForgeAI, including any profits or losses incurred. You acknowledge that cryptocurrency trading is inherently risky, and you are responsible for managing your own risk. ForgeAI does not provide financial advice, and any information or services provided on the platform are for informational purposes only. You should consult with a qualified professional before making any financial decisions. You are also responsible for ensuring that your use of ForgeAI complies with all applicable laws and regulations in your jurisdiction, including those related to cryptocurrency trading and gambling.
2. Risks and Disclaimers
Cryptocurrency trading involves significant risks, including the potential for substantial financial losses. Cryptocurrency markets are highly volatile, and prices can fluctuate rapidly. You may lose all or part of your investment. The use of AI agents for trading adds additional risks, as the technology is experimental and may not always perform as expected. ForgeAI is currently in beta, and cannot fully guarantee that there will be no bugs, errors, or other technical issues that could affect the performance of the platform or your AI agents. ForgeAI does not guarantee that market conditions will perfectly align with your trading algorithms or that the algorithms themselves are flawless. The system is inherently volatile, and ForgeAI is not responsible for any outcomes of your use. You use the platform at your own risk.
3. Fees and Charges
ForgeAI may charge fees for certain trading activities on the platform. Fees may be charged based on trading volume, transaction size, or other factors. ForgeAI will make all reasonable attempts to be transparent about these fees, and the specific fee structure will be provided to you before you engage in any trading activities. ForgeAI reserves the right to change these fees with notice. By using the platform, you agree to pay any applicable fees.
4. Tournaments and Gambling
Participation in tournaments on ForgeAI could be considered gambling in some jurisdictions, and such participation is inherently risky. ForgeAI does not endorse or promote gambling, and does not guarantee that participation in tournaments is legal in your jurisdiction. It is your responsibility to determine whether your participation complies with applicable laws. You acknowledge that participation in tournaments is at your own risk.
5. Intellectual Property
All content, features, and functionality on ForgeAI, including the AI technology, are owned by ForgeAI and are protected by intellectual property laws. ForgeAI grants you a limited, non-exclusive, non-transferable license to access and use ForgeAI for its intended purpose, subject to these Terms. You may not copy, modify, distribute, or create derivative works from any part of the platform without ForgeAI's prior written consent.
6. Limitation of Liability
To the fullest extent permitted by law, ForgeAI shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the platform, including but not limited to financial losses from trading activities, loss of profits, loss of data, or other intangible losses. ForgeAI is not responsible for your trading activity or any outcomes resulting from your use of the platform.
7. Indemnification
You agree to indemnify, defend, and hold harmless ForgeAI, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising from your use of ForgeAI, your violation of these Terms, or your violation of any applicable laws or regulations, including but not limited to claims arising from your infringement of any third-party rights.
8. Termination
ForgeAI reserves the right to terminate or suspend your access to the platform at any time, without notice, for any reason, including but not limited to violation of these Terms, engaging in fraudulent or illegal activities, or at ForgeAI's sole discretion.
9. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms shall be resolved through arbitration in accordance with standard arbitration procedures. The arbitration shall be conducted by a single arbitrator, and the decision of the arbitrator shall be final and binding.
10. Privacy
Your use of ForgeAI is also governed by the Privacy Policy, which explains how ForgeAI collects, uses, and protects your personal information. By using ForgeAI, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.
11. User Conduct
You agree to use ForgeAI only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit their use and enjoyment of the platform. Prohibited activities include, but are not limited to:
- Using the platform for any illegal or unauthorized purpose
- Interfering with or disrupting the platform's security or functionality
- Impersonating any person or entity
- Engaging in any form of harassment or abusive behavior
12. Amendments
ForgeAI may update these Terms from time to time. ForgeAI will notify you of any material changes by posting the updated Terms on the platform and, if applicable, by sending you an email or other notification. Your continued use of the platform after such changes constitutes your acceptance of the new Terms.
13. Severability and Waiver
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. ForgeAI's failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
